Administrator means 360insights USA Ltd.
Bosch means Robert Bosch Tool Corporation.
Experience Reward means an activity-based Reward from the online catalog as shall form part of the Program.
Program means the Bosch Dealer Rewards Program and all its component parts as the same may be amended from time to time.
Rewards means such reward items, including Experience Rewards, digital media, gift certificates and gift cards (in physical or electronic form), prepaid cards and vouchers from the online catalog, prizes, branded items, and other such one-off awards that You may redeem Reward Points to purchase, as shall form part of the Program.
Reward Points means points awarded to You that may be used redeemed for Rewards under the terms and conditions of the Program.
Website means the website at www.boschdealerrewards.com.
These Terms and Conditions of Use apply to Bosch’s Dealer Rewards Program:
By accessing, transacting Reward Points, or using any aspect of the Program or Website, you, the individual participating in the Program (“You”; “Your” has the correlative meaning) agree to be bound by the terms and conditions of use set forth on this webpage (these “Terms and Conditions of Use”) and the terms, conditions, disclaimers, and limitations of liability posted in the rewards page by the Administrator on the Website. Bosch reserves the right to amend or update any of these Terms and Conditions of Use at any time without providing notice to You. By using the Website, You acknowledge that You have read and understood these Terms and Conditions of Use.
Account. In order to participate in the Program and use the Website, you must register for a user account via the central Bosch ID (“Account”), which enables signin to the Website. For more information on the central Bosch ID, please see “Registration Via the Central Bosch ID” below. During the registration process, you must provide certain information about yourself and the entity you represent as prompted by the Account registration form. You represent and warrant that: (a) all required Account information you submit is truthful and accurate; (b) the Account information does not include any personal information regarding any individual other than you; (c) you will maintain the accuracy of such information; (d) your use of the Program or the Website does not violate any applicable law or regulation; and (e) you are a resident of, and located in, the United States. You are entirely responsible for maintaining the confidentiality of your Account login information and for all activities that occur under your Account (including under your Program account). You agree to use “strong” passwords that use a combination of upper- and lower-case letters, numbers, and symbols with your Account, and to maintain your password securely to prevent others from gaining access without your permission. You agree to immediately notify Bosch of any unauthorized use, or suspected unauthorized use, of your Account, the Program, the Website, or any other breach of security. Bosch is not liable for any loss or damage arising from your failure to comply with the above requirements.
Because the Program and the Website is accessible online and through the internet, Bosch will assume that any activity taken through your Account or using your Account credentials is authorized and directed by You. You are legally responsible for all activities that occur under or with respect to your Account, even if a person gained access to your Account without your permission. We have no obligation to investigate the authorization or source of any access or use of the Program or the Website that purports to be you, such as activity through your Account.
Registration Via the Central Bosch ID. You may register for our online offers exclusively using the central Bosch ID. The central Bosch ID was devised by Robert Bosch GmbH for the Bosch Group in order to allow for the joint users to benefit from offers of different group companies using centralized application data and increase data safety.
Robert Bosch GmbH, Robert - Bosch - Platz 1 70839 Gerlingen - Schillerhöhe, Germany (“RBG”) is responsible for the provision of this single sign-on service.
If you want to apply for a central Bosch ID, the General Terms of Use for the Registration and Use of a central Bosch ID and the Data Protection Notice of RBG shall apply . Without limiting the generality of the foregoing, if you apply for a central Bosch ID, Robert Bosch GmbH may collect, transmit, store, or otherwise process your personal information outside the country where you are located, and such data may be accessible to courts, law enforcement, and national authorities in such other jurisdiction(s).
After successful registration you may utilize the registration data used for the central Bosch ID also for registering for this online offer. To this end, we shall provide a registration template for the central Bosch ID. RBG then shall confirm your authorization via token. Your password shall not be communicated to us.
Concerning further data transfers within the Bosch Group associated with the central Bosch ID, please refer to the Data Protection Notice. You may cancel your user agreement concerning the central Bosch ID at any time by unregistering. You hereby represent that You (a) are a resident in the USA, (b) are at least 18 years of age (or the age of majority in the jurisdiction You live in), and (c) have obtained the prior permission of Your employer to participate in this Program. If You do not meet these criteria, You are not permitted to participate in this Program. This Program cannot be combined with any other Bosch programs, offers or rebates.
The Program and its benefits are offered at the discretion of Bosch and its affiliated companies, and Bosch has the right to terminate the Program or to change the Program terms and conditions (including these Terms and Conditions of Use), rules, benefits, conditions of participation or rewards levels, in whole or in part, at any time, with or without notice, even though changes may affect the value of the Reward Points (if used as part of the Program) already accumulated. It is Your responsibility to maintain knowledge of these Terms and Conditions of Use.
You may not be able to obtain Reward Points on all products or all sales.
Employees of Bosch, its affiliated companies, advertising agencies, gift suppliers or other representatives, or members of the respective immediate families of such employees and anyone with whom such employees are domiciled are not eligible to participate in the Program.
Bosch will post current Program promotions, including details on promotion objectives, timeframes, metrics, redemption requirements and qualifying criteria, from time to time at www.boschdealerrewards.com. Bosch is not responsible for lost, corrupted or delayed entries. Participation constitutes full and unconditional acceptance of these Terms and Conditions of Use. Any failure by You to follow the rules of the Program or these Terms and Conditions of Use, any abuse of the Program, any conduct detrimental to the interests of either Bosch or the Administrator, or any misrepresentation of any information furnished to Bosch, or the Administrator may result in the termination of Your participation in the Program, the termination of Your Program account and the cancellation of Your accrued Reward Points and/or benefits.
This Program runs from April 1st, 2022, and is ongoing until further notice.
The Administrator may collect personal data which You provide when You register for the Program. The definition of “personal data”, the purpose(s) for which such personal data is collected and shared, the way in which it is used, and Bosch data collection practices, are set out in the Privacy Policy found on the Website. By checking the ‘accept terms and conditions’ box on the Website, You confirm that you have read understood the Privacy Policy and that You consent to the collection and use of such personal data as described in the Privacy Policy.
Reward Points will be awarded to each You based on whether you have met the applicable promotion criteria for the applicable time period as set forth at www.boschdealerrewards.com.
You may opt to either:
Reward Points must be redeemed via the Website. Rewards, once chosen, can only be changed if You contact the Administrator’s customer service team at [email protected] within 24 hours of the redemption.
Reward Points will expire after 12 months of allocation to Your Program account unless redemptions are made within that 12-month period.
Fraudulent use of Program accounts and Reward Points on Your Program account will result in the Program account being immediately suspended. Fraudulent activity may result in the termination of Your Program account and the cancellation of accrued Reward Points, Rewards and/or benefits.
Reward Points will be automatically credited to Your Program account on redemption of an instant points voucher code. Codes must be redeemed prior to the published expiry date.
If prepaid debit cards are offered as Rewards as part of the Program (a “Prepaid Reward Card”), Reward Points must be redeemed via the Website directly onto a Prepaid Reward Card. You acknowledge and agree that the Administrator and/or the issuer of any Prepaid Reward Card may reject any application or request for a Prepaid Reward Card for any reason, and that none of Bosch, Administrator or such issuer shall have any liability whatsoever in connection with such rejection.
All Prepaid Reward Card must be activated prior to use by following the instructions given by the Prepaid Reward Card issuer.
You must agree to the Prepaid Reward Card issuer’s terms which will be made available to You prior to any redemption of an applicable prepaid card as a Reward. Additional cardholder fees apply.
In the case where the cumulative Prepaid Reward Card load exceeds any applicable KYC (Know Your Customer) limit, additional KYC information may be required from You to enable the card to be upgraded. The Prepaid Reward Card will not be loaded with any further funds until KYC has been completed. A list of acceptable KYC documents can be supplied by the Prepaid Reward Card issuer.
You acknowledge that the Prepaid Reward Card issuer may retain Your data and has the right to suspend the prepaid debit card service in the event of such an instruction being made by any governmental, law enforcement or regulatory authority or if misuse or fraudulent activity is suspected. None of the Administrator, the card provider or Bosch shall have any liability for direct or indirect losses as a result of suspension of the prepaid debit card service. You further acknowledge that any Prepaid Reward Card issuer may retain data, including, without limitation, personal information, about You, and that, and that such issuer’s collection, maintenance and use of such data is subject to such issuer’s own privacy notice and is not the responsibility of Bosch or Administrator. Please refer to your Prepaid Reward Card issuer’s terms and conditions and privacy notice for more information
You must advise the Administrator immediately on becoming aware that any Prepaid Reward Card has been lost or stolen. If the Administrator is properly notified, Prepaid Reward Cards declared as lost in transit which have not been activated will be replaced by the Administrator.
Once a Prepaid Reward Card is activated, all risk for the funds on the Prepaid Reward Card passes to You. In the event of a lost, stolen, or damaged Prepaid Reward Card, the Prepaid Reward Card issuer may issue a replacement card with the available balance at the point of notification transferred to a new Prepaid Reward Card less any applicable charges for re-issuance.
In the case of misuse or fraudulent activity of a Prepaid Reward Card service, You acknowledge that You must comply with all requests for data or actions to be taken as given by the Administrator, the Prepaid Reward Card issuer or any governmental, law enforcement or regulatory authority. You further agree that you will provide any data required by the issuer any Prepaid Reward Card or a regulatory authority of competent jurisdiction.
You acknowledge that the issuer of any Prepaid Reward Card may terminate its prepaid card service at any time, including if the issuer is instructed to terminate such service by the applicable regulatory authority. In such an event, the only refundable portion of the of the total amounts paid to You on any Prepaid Rewards Cards are those funds remaining on any Prepaid Reward Cards issued to you. You acknowledge that any such termination is outside the control of Bosch and the Administrator and that neither Bosch nor Administrator will have any further liabilities or recourse beyond refunding You the funds remaining on such Cards as a result of termination by the issuer or other legal or regulatory authority.
Reward Points may only be redeemed via the Website. Rewards, once chosen, can only be changed if You contact the Administrator’s customer service team at [email protected] within 24 hours of the redemption.
Reward Points cannot be redeemed for cash, check, bank deposit or any other kind of payment by Bosch to You.
You may not pool, transfer or combine Reward Points with any other participant in the Program or person in order to redeem Rewards.
You may not combine cash, checks, bank deposits or any other kind of payment with Reward Points to redeem Rewards. Rewards can only be redeemed by using Reward Points.
Delivery is only available to addresses in the United States of America.
Experience Rewards will be fulfilled by Your direct arrangement with the Experience Reward supplier, in accordance with each individual supplier’s terms and conditions, availability, lead-time and capability.
In the case of a Reward not being available (whether through obsolescence, discontinuance, or lack of available stock or otherwise), either the Administrator or its supplier will contact You within 7 days of placing the order and offer a replacement Reward of similar value. If You do not wish to accept the replacement Reward, the original value of the Reward deducted from Your Program account will be re-credited.
The Administrator and its suppliers each reserve the right to remove or include any Reward from the range available to You at its discretion and You may not rely upon the continued availability of a Reward category or individual Reward.
The Administrator will endeavor to honor any Rewards that have already been ordered by You prior to any price alterations.
The delivery of Rewards will be made to You by the supplier(s) engaged by the Administrator. Shipping and delivery lead times vary but are not expected to exceed 25 business days. Wherever possible, the supplier(s) engaged by the Administrator will notify You via email or by phone of a Reward’s shipment arrangement and status.
The delivery of all Rewards will be made to the address as supplied by You at the time of order. The delivery address for Rewards should be to an address where the Reward can be signed for if necessary. If a delivery is unsuccessful for any reason, You will be responsible for supplying alternative delivery information to the supplier. Any costs of arranging re-shipment and handling of undelivered items will be passed on to You. Lead times for any re-delivery will be at the discretion of the supplier.
You must refuse delivery of damaged or broken Rewards if apparent before opening the package and the supplier must be advised by You within 24 hours of the delivery date so that the supplier can investigate and, if authorized by the supplier, arrange for replacement Reward(s) to be shipped. If the package is opened and the Reward is then found to be damaged or broken then the supplier must be advised by You within 24 hours of the delivery date so that the supplier can investigate and, if authorized by the supplier, arrange for replacement Reward(s) to be shipped. Any damaged or broken Rewards must be returned by You immediately to the supplier in the original condition. The supplier will pay for return shipment and subsequent re-shipping of the Reward, subject to continued availability. The supplier will only offer a replacement for Rewards that are damaged or broken when received by You. For Rewards that are not damaged or broken but are not in working condition or faulty, the supplier will not replace the Reward, but will assist You in contacting the manufacturer to facilitate after-sales support.
You acknowledge that some Rewards are not returnable and non-refundable (e.g., items with a customized aspect or which are made to order, perishable goods such as flowers/food or personal items such as jewelry or cosmetics). The supplier will not accept returns for apparel that has been worn.
Once the Reward has been received by You, provided there is no damage or fault at the time of delivery, You accept all risks for the Reward and will need to contact the manufacturer if a fault develops at a later stage as per the manufacturer’s warranty terms and conditions.
Gift card and gift certificates may not be returned unless the return is due to the incorrect distribution by the supplier. All gift cards and gift certificates will be dispatched by the supplier according to the information provided by You. Neither Bosch nor the Administrator will have any responsibility for any gift certificates or gift cards that are lost or stolen once delivered. Where You report a voucher or gift card as lost or stolen, You acknowledge that a fee may be deducted from the balance of the card for the issuance of a replacement. Neither Bosch nor the Administrator is liable for any refusal of a retailer to deactivate or provide credit or replacement of a lost or stolen gift card or voucher.
Gift cards and gift certificates that are lost or stolen in transit must be reported by You to the Administrator customer service team immediately.
Gift cards and gift certificates may not be transferred or re-sold by You to any third party, whether for payment or free of charge.
Orders for gift cards and gift certificates may be fulfilled with a single card for the value redeemed or in multiples of a smaller denomination.
For orders of Rewards shipped by tracked delivery, the supplier will provide a proof of delivery document or other supporting information within 2 weeks upon inquiry of any order disputes. Courier companies will only normally provide proof of delivery for a period of up to 2 to 3 months. You must report any order disputes as early as possible. If any order dispute is raised after 2 months from the date of shipment, proof of delivery documents may not be available and none of Bosch, the Administrator nor its supplier(s) will accept any liability to You in respect of any such dispute.
Bosch and the Administrator each reserve the right in its sole discretion to cancel, modify or suspend the Program or any portion of the Program at any time with or without notice.
Notwithstanding the foregoing, You will be given written notice of Program termination which would impact Your Reward Points balance, and all Reward Points must be redeemed within 30 days following such written notice. Any Reward Points not redeemed in accordance with the foregoing will be forfeited.
To the extent any element of the Program (including, without limitation, Reward Points, Rewards, Experience Rewards) is deemed taxable income or employee compensation under applicable law or regulation, You and Bosch are solely responsible for its own compliance with any taxation requirements including, without limitation, reporting of income ore compensation and payment of any resultant taxes. Each of You and Bosch agree to furnish to the other all reasonably requested documents or information to allow You or Bosch, as the case may be, to fulfill its tax obligations hereunder. The Administrator has no responsibility for any taxation or reporting to any taxation authority and the Administrator is not responsible for obtaining or providing any tax advice to Bosch or any User.
Any Rewards redeemed by You through this Program may be treated as taxable income upon issuance of the Reward and be considered direct compensation for federal taxation purposes. Liability for federal, state, local, foreign or other taxes imposed upon You in connection with any Reward is Your responsibility. Any earnings over $600.00 within a calendar year will be reported for federal taxation purposes. You are required to share Your Social Security number in connection with these obligations.
Save as set forth above, no correspondence will be entered into regarding either this Program or these Terms and Conditions of Use. In the unlikely event of a dispute, Bosch’s decision shall be final. Bosch and/or the Administrator reserve(s) the right to amend, modify, cancel or withdraw this Program at any time without notice.
Bosch and/or the Administrator cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. You agree that Bosch and the Administrator will have no liability whatsoever for any injuries, losses, costs, damage, or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a Reward, or from participation in this Program. Nothing in this clause shall limit Bosch’s or the Administrator’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.
